1. Parties
This Service Agreement (“Agreement”) is between you (“you,” “User”) and the operator of Face On Me at faceonme.com (the “Operator,” “we,” “us”). Face On Me is a consumer face-swap and recording tool. By using the Service you enter a contract with the Operator. If you do not agree, do not use Face On Me.
2. Acceptance
You accept this Agreement by tapping Record, by creating an account, or by paying for membership. Recording is not blocked and no checkboxes are required first. The first time you record, this device stores the date and time, the Terms version, and either your account (if you are signed in) or an anonymous device id. Creating an account records that acceptance on the account as well. Electronic acceptance has the same force as a signed writing. If we post a new version, the camera shows the full agreement line once more. That notice does not block recording. Tapping Record on the new version is acceptance of it.
The following statements are part of this Agreement. They are the full text of the notice that previously appeared before you could record:
- You are solely responsible for every video you create. Face On Me and its owner are not publishers of your content and are not liable for how you use it.
- I am 18 years of age or older.
- I am solely responsible for every video and image I create, save, share, or post.
- I have the legal right to use every face and likeness I apply. I will not impersonate, defraud, or harass anyone.
- I agree to the Service Agreement and Privacy Policy.
3. Eligibility
You must be at least 18 years old. Face On Me is not directed to children. You represent that you have legal capacity to enter this Agreement. If you use the Service on behalf of an organization, you bind that organization and you have authority to do so.
4. The Service
Face On Me lets you apply looks and faces to a live camera or still and record video or photos on your own device. Output stays on your device. We do not upload your videos to our servers. We do not promise any particular quality, likeness, uptime, or result. Features, prices, watermarks, and limits may change. Free use is limited. Membership is optional and billed through Stripe.
5. You are solely responsible for your content
You are the sole creator, owner, publisher, and distributor of every video, photo, recording, restyle, caption, and file you make with Face On Me (“User Content”). Videos stay on your device. We do not save them on our servers. The Operator does not review or publish your User Content. You—not Face On Me, not the Operator, not any owner, officer, employee, or affiliate—are fully responsible for User Content and for every consequence of creating, storing, sending, posting, or showing it.
6. Faces, likenesses, and deepfakes
You represent and warrant that you have all rights, consents, and licenses needed to capture your image and to apply any face, identity, or likeness (including celebrity, public figure, or third-party faces). You will not use Face On Me to impersonate another person in a misleading, defamatory, fraudulent, or illegal way; to create non-consensual intimate imagery; to interfere with elections; to commit fraud, harassment, stalking, or revenge; or to violate publicity, privacy, or intellectual-property rights. Synthetic media can be illegal in some places. You are responsible for knowing and following the law where you are.
7. Prohibited uses
You will not use the Service for child sexual abuse material or any sexual content involving minors (real or depicted); for scams, malware, or spam; to break any law; to reverse engineer or overload the Service; to scrape other users; or to bypass watermarks, membership gates, or security. We may refuse, suspend, or terminate access for any reason, including suspected abuse.
8. Watermarks and membership
Free videos have one small logo in the corner. Anyone may record, play, and save. Membership is a personal, non-transferable license to receive watermark-free output. Watermarks do not mean we endorse the video. Fees are charged by Stripe. Taxes may apply. Subscriptions renew until you cancel in Stripe or through the billing portal. Refunds, if any, follow Stripe and applicable law. We may change prices with notice on the membership page. You remain responsible for User Content whether or not you pay.
9. Accounts
You are responsible for your login and for activity under your account. Notify us of unauthorized use. We may reclaim usernames and close accounts that violate this Agreement.
10. Intellectual property
Face On Me, its name, looks, software, and design are owned by the Operator. You keep whatever rights you already have in your own footage. You grant the Operator a limited license to process your session as needed to run the Service (including crash logs, membership records, and the visitor analytics described in the Privacy Policy). We do not save or claim ownership of your videos.
11. No professional advice
Face On Me is entertainment software. Nothing here is legal, medical, or professional advice.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT ALLOWED BY LAW, THE OPERATOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUT WILL BE ACCURATE, FLATTERING, SAFE TO POST, OR FREE OF DEFECTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE. YOU USE FACE ON ME AT YOUR OWN RISK.
13. Limitation of liability
TO THE MAXIMUM EXTENT ALLOWED BY LAW, THE OPERATOR, ITS OWNER, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF THE SERVICE OR YOUR USER CONTENT, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR MEMBERSHIP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) TEN U.S. DOLLARS ($10). SOME PLACES DO NOT ALLOW CERTAIN LIMITS; IN THOSE PLACES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED. YOU AGREE THIS LIMIT IS A FAIR ALLOCATION OF RISK AND A BASIS OF THE BARGAIN.
14. Indemnification
You will defend, indemnify, and hold harmless the Operator, its owner, and their officers, directors, employees, contractors, and affiliates from any claim, demand, loss, damage, judgment, cost, or expense (including reasonable attorneys’ fees) arising out of: (a) your User Content; (b) your use or misuse of Face On Me; (c) your violation of this Agreement or any law; (d) your violation of any person’s rights, including privacy, publicity, defamation, and intellectual property; or (e) any face, name, or likeness you apply. We may assume exclusive defense of any matter, and you will cooperate.
15. Release
You release the Operator and its owner from any claim related to User Content created by you or by other users, including claims for defamation, publicity, false light, and emotional distress, to the fullest extent allowed by law (including California Civil Code § 1542 if it would otherwise apply).
16. Third-party services
Payments run through Stripe. Sign-in may use Google or X. Those providers have their own terms. We are not responsible for their acts or outages.
17. Copyright
If you believe material on Face On Me infringes your copyright, send a notice that complies with 17 U.S.C. § 512 to the contact on faceonme.com with: your signature, the work claimed, the material, your address and email, a good-faith statement, and a statement under penalty of perjury that you are authorized. We may remove material and terminate repeat infringers.
18. Termination
You may stop using the Service at any time. We may suspend or end access immediately for any reason. Sections that should survive (including 5–7 and 12–15, 19–21) survive termination. Membership fees already paid are handled under Stripe’s rules and the law.
19. Governing law and venue
This Agreement is governed by the laws of the State of New York, without regard to conflict-of-law rules. Exclusive venue for disputes is the state or federal courts located in New York County, New York, and you consent to personal jurisdiction there. You waive class actions and jury trial to the extent allowed by law. If a court finds a provision unenforceable, the rest remains in force.
20. Miscellaneous
This is the entire agreement for the Service. It supersedes prior terms. You may not assign it without our consent; we may assign it. Failure to enforce is not a waiver. Headings are for convenience. “Including” means “including without limitation.” There are no third-party beneficiaries except the indemnified Operator parties in sections 13–15.
